Who has the obligation to prepare an emergency plan?

  • The employer must prepare an emergency plan in the following cases:
  • Companies with at least 10 employees.
  • Places open to the public with more than 50 people present.
  • Places subject to fire prevention certificate (CPI).

This is to prevent fires and ensure the safety of everyone.

Penalties
The emergency plan may be required during inspections by ASL technicians, labor inspectors or firefighters. In case of failure to compile it, the penalties the employer may incur start from a minimum of 1,474 to a maximum of 6,388 euros and also to criminal penalties (Art. 46). The lack of an emergency plan can also result in the suspension of business activity.

What is the emergency plan?

  • Small workplaces. The plan may be limited to simple written notices with rules of behaviour.
  • Places with several owners (e.g. in the same building). Plans should be drawn up in cooperation between employers.
  • Large facilities or complex locations. The plan should include a floor plan with details of: escape routes, fire compartmentalisation, use of areas; location of fire-fighting equipment and alarm systems; location of main switches and valves for water, gas or combustible fluids.
